HSF Indonesia carries out first step of cooperation agreement with Indonesian Ministry of Justice and Human Rights (MenHumKam)
The two days of training with the title “Litigator Training on Judicial Review related to the Compatibility of Regulations in line with the Indonesian Constitution” were conducted from 28th till 29th of September 2011. The 50 participants of the event were mainly comprised of experts of the Indonesian Ministry of Justice and Human Rights, representatives of law centers in the region, as well as legal departments of other Indonesian ministries, e.g. the Ministry of Transportation and the Ministry of Agriculture.
The training consisted of the following two parts:
On the first day of the event various lectures about the meaning of the constitutional compliance of laws were held. With their lectures, the two former Indonesian constitutional judges, Dr. Maruarar Siahaan and Professor Natabaya, emphasized the importance of the filing and distribution of verdicts of the constitutional court. As many verdicts aren’t published in a government gazette and consequently aren’t familiar in the various Indonesian regions, it becomes apparent that verdicts often aren’t followed up and implemented. The two former constitutional judges pointed out the exemplary practice in the German judicial system which should also be brought forward in Indonesia. Other speakers were Dr. Refli Harun, member of the association of constitutional experts at Indonesian universities (APHAMK), Dr. Mualimin Abdi, SH., MH., constitutional expert at the Ministry of Justice and the Indonesian Constitutional Court, as well as Ms. Cholila, SH, M.H., director of legislation, publishing and cooperation.
The second day of the training was then characterized by interactive working with the participants. The trainers taught the participants methods and techniques of the review of laws and regulations which can be applied directly in the respective professional customs.
